Ratio

The Acting President made a consent order re-establishing an Interim Board of Directors for the Western Australian Police Union of Workers, as the previous interim order had lapsed on 20 May 2016 without variation. The parties had mistakenly believed the Interim Board continued post-lapse, and reconstitution was necessary pending the Full Bench's determination of an application for a s71 certificate that would enable the officers of the PFA Branch to become the officers of the Union.

Key facts · 7

  • An interim order was made on 19 May 2015 establishing an Interim Board of Directors ([2015] WAIRC 00390).
  • Order 1 was amended on 11 June 2015 to add two additional Directors ([2015] WAIRC 00436).
  • Order 1 was re-amended on 23 October 2015 to substitute the names of Interim Board Directors following election results of the Police Federation of Australia – Western Australia Police Branch ([2015] WAIRC 00957).
  • Order 9 provided that the interim order would cease to have effect on 20 May 2016 unless varied.
  • No variation application was made by the parties prior to 20 May 2016, and the interim order lapsed.
  • The parties acted under an honest but mistaken belief that the Interim Board continued to be constituted after the interim order ceased to have effect.
  • A Full Bench application (FBM 1 of 2018) is pending for a s71 certificate to enable PFA Branch officers to become Union officers.

Factors

For
  • The Interim Board should be re-established because the Full Bench has not yet heard and determined the s71 application.
  • The parties acted under an honest but mistaken belief that the Interim Board continued post-lapse, warranting remedial action.
