DECISION [1] The Commission, after hearing the parties determines by consent that: (a) There is in operation a State employment agreement of the type described in s.111A AA(1) of the Workplace Relations Act 1996 (the Act) and as no evidence has been given or submissions made relating to the public interest, the Commission will refrain from determining that part of the dispute that relates to Golding Contractors and its employees engaged to perform work at the Ensham Coal Mine; (b) A consent roping-in award will be made.
