1 Fair Work Act 2009 s.394—Unfair dismissal Paola Marafioti v Gonzalez Pty Ltd T/A Mac’s Crafts (U2017/7263) COMMISSIONER BISSETT MELBOURNE, 26 OCTOBER 2017 Application for an unfair dismissal remedy – dismissal not consistent with small business fair dismissal code - applicant unfairly dismissed - compensation ordered. A. In accordance with the decision in this matter issued on 26 October 20171, I order that: 1. Pursuant to s.392 of the Fair Work Act 2009 that Gonzalez Pty Ltd T/A Mac’s Crafts pays to Ms Paola Marafioti (Applicant) as compensation in lieu of reinstatement an amount of $6,723.92 plus 9.5% superannuation to be paid into the Applicant’s superannuation account. 2.
