O'Connor on behalf of the Respondents, the Commission, pursuant to the powers conferred on it under the Industrial Relations Act 1979. and by consent, hereby makes the following Award to be operative on and from 31 March 1989. (Sgd.) J.A. NEGUS, [L.S.] Commissioner. Award No. A3 of 1988. 1.—Title. This Award shall be known as the Contract Cleaning (FMWU) Superannuation Award 1988. 2.—Arrangement. 1. Title. 2. This Award shall apply to cleaning contractors and their employees whose wages and conditions of employment are otherwise governed by the Cleaners" (General and Window) Contractors' Award. 4.—Locality. This Award shall apply throughout the State of Western Australia. 5.—Term of Operation. This Award shall come into effect on and from the first entry date after 31 March 1989 and shall remain in force for a period of two years. 69 W.A.LG. WESTERN AUSTRALIAN INDUSTRIAL GAZETTE 1451 6.—Definitions. "Entry date" shall mean the first day of each month. "Eligible employee" shall mean an employee who has served a qualifying period of three calendar months' continuous service with the employer prior to his/her entry date. "The fund" shall mean Westscheme, the Australia Retirement Fund (ARE) established by Trust Deed and Articles on 11 July 1986, or any other approved Fund Scheme provided for in accordance with the provisions of this Award. "Approved fund" shall mean a fund which has been established by and on behalf of the employer for the purposes of occupational superannuation and which complies with the Australian Government's operational standards for occupational superannuation. "Ordinary time earnings" shall mean the salary, wages or other remuneration periodically received by the employee in respect of the time worked in ordinary hours and shall include shift work penalties in the case of the employee being a shift worker, payments which are made for the purpose of district or location allowances or any other rate paid for all purposes of the Award to which the employee is entitled for ordinary hours of work provided that "ordinary time earnings" shall not include any payment which is of a similar nature to or is paid for the same reaons as, or is paid in lieu of payments for overtime, disability payments, vehicle allowances, fares or travelling time allowances (including payments made for travelling relating to distant work), commission or bonus.
