1 Fair Work Act 2009 s.789FC - Application for an order to stop bullying Andie Sole (AB2026/315) COMMISSIONER MCKINNON SYDNEY, 10 JULY 2026 Application for an FWC order to stop bullying [1] On 29 April 2026, Ms Andie Sole applied for an order to stop bullying at work under s.789FC of the Fair Work Act 2009 (the Act). The application was made in relation to Star Weekly and a person with whom Ms Sole interacted while she was at work. At the time of her application, Ms Sole was not a worker in the business of Star Weekly. She had resigned from her employment with immediate effect two days earlier, on 27 April 2026. [2] There is no dispute that the employment relationship has come to an end, that Ms Sole is no longer at work in the business of Star Weekly, and that this position is unlikely to change. Although Ms Sole refers to the possibility of interaction with representatives of Star Weekly while working more broadly in the industry in future, this would not be an interaction occurring while Ms Sole was at work in the business of Star Weekly. It could not be bullying at work of the kind alleged in Ms Sole’s application. [3] In the circumstances, I am not satisfied that there is any risk that Ms Sole will continue to be bullied at work. The Commission could not make any orders in the matter if it were to proceed to hearing.
