1 Fair Work Act 2009 s.365 - Application to deal with contraventions involving dismissal William Mactaggart v Toyota Finance Australia Ltd (C2026/5158) DEPUTY PRESIDENT COLMAN MELBOURNE, 6 JULY 2026 Application under s 365 – no dismissal – application dismissed [1] At the conclusion of a brief telephone hearing earlier this morning, I dismissed an application made by William Mactaggart under s 365 of the Fair Work Act 2009. It was obvious that he had not been an employee of the respondent, Toyota Finance Australia Ltd (Toyota), and had not been dismissed. Instead, Mr Mactaggart was employed by Hays Recruitment, which deployed him on an assignment at Toyota. Nine days later, Toyota instructed Hays to end his assignment, and it did so. This was clear from correspondence that Mr Mactaggart attached to the application. Toyota did not employ or dismiss Mr Mactaggart. He was not eligible to make an application under s 365.
