WESTERN AUSTRALIAN INDUSTRIAL RELATIONS COMMISSION. Industrial Relations Act 1979. Diane Margaret Robertson and Public Service Commissioner. No. PSAB1 of 1990. PUBLIC SERVICE APPEAL BOARD. COMMISSIONER S.A. KENNEDY, Chairperson MR A. ERRINGTON. Member MR R. McDONALD. Member. 3rd day of August 1990. Order. HAVING heard Mr K. Dodd on behalf of the Appellant and Mr R. Cock (of Counsel) on behalf of the Respondent, now therefore pursuant to the powers conferred by the Industrial Relations Act 1979, the Public Service Appeal Board by majority decision hereby orders — (1) That the Respondent offer Diane Margaret Robertson a position commensurate with her skills in the Public Service within the metropolitan area at no less than Level 3 within 14 days of the 3rd day of August 1990. (2) That on receipt of an offer pursuant to (1) hereof, Diane Margaret Robertson shall either accept or reject such offer in writing within seven days from the date of its receipt. (3) That in the event of an acceptance pursuant to (2) hereof, the date on which such employ- ment is to commence shall be as mutually agreed between the Appellant and the Respondent provided that in any event it shall be no later than seven days from the date of such acceptance. (4) That in the event of re-employment pursuant to (1) and (2) hereof, the Appellant's prior experience in the Public Service to 3 October 3457 1989 shall be deemed relevant for the purposes of promotion and shall be taken into account on its merits. (5) That in the event of a rejection pursuant to (2) hereof, the Respondent shall be deemed to have complied with this Order in all respects. (Sgd.) S.A. KENNEDY, [L.S.] Commissioner.
