Unsuccessful negotiations for proposed new enterprise agreement
RECOMMENDATION

This matter relates to the notification pursuant to s. 170NA(1) of the
Workplace Relations Act 1996
(the Act) by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (the Union) as a means of facilitating discussions with Volvo Truck Australia Pty Ltd (the Company) following unsuccessful negotiations for a proposed enterprise agreement. As a result of a conciliation conference involving the parties, where the history of the negotiations was considered, the following Recommendation is provided by the Commission:
It is recommended that current industrial action should cease following the reporting of this Recommendation to Employees by the Union at the scheduled meeting at 6:00am on 4 December 2003.
A meeting is to be held between the Union and the Company for the purpose of progressing negotiations towards the finalisation of a certified agreement. As organised at the conference before the Commission, Mr Smith (on behalf of the Union) and Mr Silversides (on behalf of the Company) will participate in the negotiating meetings to occur on Thursday 4 December and Friday 5 December 2003.
A report-back to the Commission is scheduled for 10:00am on Monday 8 December 2003.
No further industrial action is to be taken by any party at the workplace prior to the report-back to the Commission.
