Kazakoff on behalf of the applicant and there being no appearance on behalf of the respondent, the Commission, pursuant to the powers conferred on it under the Industrial Relations Act 1979, hereby orders – THAT the Building Materials Manufacture (CSR Limited - Welshpool Works) Award, 1982 be varied in accordance with the following schedule and that such variations shall have effect from the first pay period commencing on or after the 11th day of March 2005. (Sgd.) A R BEECH, [L.S.] Chief Commissioner. SCHEDULE 1. Clause 7 – Overtime: Delete subclause (9) of this clause and insert the following in lieu thereof: (9) Meal Money: Where an employee has to work before the usual starting time or after the usual ceasing time for one and one-half hours or more, in either case, he/she shall be paid $7.55 for a meal. Any employee required to work a further four hours' overtime shall be paid a further $7.55. If an employee pursuant to notice has provided a meal or meals and is not required to work overtime, he/she shall be paid $7.45 for each meal provided. 2. Clause 9 – Wages: (A) Delete paragraphs (b) and (c) of subclause (1) of this clause and insert the following in lieu thereof: (b) Provided that an employee qualified Senior Hand Gyprock or Warehouse appointed as Shift Boss shall be paid an all purpose allowance of $116.79 per week. (c) Provided further that a Shift Boss may appoint on a day to day basis and subject to work requirements, a Deputy Shift Boss who shall be paid a flat allowance of $7.08 per shift. (B) Delete subclauses (5) and (6) of this clause and insert the following in lieu thereof (5) First Aid Allowance: An employee qualified to act as a first aid attendant and appointed to act as a first aid attendant in association with other work under this award shall be paid an allowance of $13.92 per week. (6) Extra Rates: (a) Employees who are required to clean the forming machine drain and pit shall be paid a flat allowance of $3.42 for each day when this work needs to be performed. (b) In addition to the rates set out in subclauses (1) and (2) of this clause any Products Handler who is appointed a leading hand shall receive a weekly allowance as follows: not more than 10 employees $26.29 more than 10 employees $39.27 3. Clause 16 – General Conditions: Delete paragraph (g) of subclause (1) of this clause and insert the following in lieu thereof: (g) An employee who is required to launder his work clothing in accordance with this clause shall be paid an allowance of $3.57 per week. And further, with the consent of the parties, the Commission records the following basis for variations: 1. The agreed Key Minimum Classification in this Award is Wage Group 2. 2. For Work Related Allowances – the percentage increase in: • Clause 9. – Wages is derived from $17 divided by $525.80 equals 3.23% and $19 divided by $542.80 equals 3.5% (two years calculations) as prescribed by Principle 5. Adjustment of Allowances and Service Increments of the State Wage Case. “allowances which relate to work or conditions which have not changed and service increments may be adjusted as a result of the arbitrated safety net increase . . . the method of adjustment shall be that such allowances and service increments should be increased by a percentage derived as follows: divide the monetary safety net increase by the rate for the key classification in the relevant award immediately prior to the application of the safety net increase to the award rate and multiply by 100.” 3. For Expense Related Allowances: • Clause 7. - Overtime has been varied for the CPI for the period September 2002 to December 2004 giving the percentage of 7.19%.
