Evidence in chief other than that contained in the witness statements may only be adduced by leave of the Appeal Board. (2) THAT not less than eight weeks prior to the first day of hearing, the appellant file and serve upon the respondent: (a) a list of witnesses he intends to call at the hearing; (b) any witness statements upon which he intends to rely with copies of documents referred to by the maker of the statement being annexed to it; and (c) any documents not annexed to his witness statements upon which he intends to rely. (3) THAT not less than four weeks prior to the first day of hearing, the respondent file and serve upon the appellant: (a) a list of witnesses it intends to call at the hearing; (b) any witness statements upon which it intends to rely with copies of documents referred to by the maker of the statement being annexed to it; (c) any documents not annexed to its witness statements upon which it intends to rely; and (d) any further documents not filed and served under subpar (b) or (c) above dealing with the subject matter of the proposed evidence of its witnesses. 97 W.A.I.G.
