WESTERN AUSTRALIAN INDUSTRIAL RELATIONS COMMISSION PARTIES ROY FROST APPLICANT -v- NATIONAL JET EXPRESS PTY LTD RESPONDENT CORAM COMMISSIONER T KUCERA DATE WEDNESDAY, 5 APRIL 2023 FILE NO/S B 7 OF 2023 CITATION NO. 2023 WAIRC 00192 Result Programming orders issued Representation Applicant Mr S Edwards as agent Respondent Mr A Mossop of counsel Order WHEREAS this is an application pursuant to s 29(1)(d) of the Industrial Relations Act 1979 (WA) (The IR Act) AND WHEREAS a directions hearing was held on 6 April 2023 and the Commission issued Order [2023] WAIRC 00186 programming the application; AND WHEREAS Order [2023] WAIRC 00186 contained incorrect dates; NOW THEREFORE the Commission will issue amended orders in replacement of Order [2023] WAIRC 00186; HAVING heard from Mr S Edwards as agent on behalf of the applicant and Mr A Mossop of counsel on behalf of the respondent, the Commission, pursuant to the powers conferred under the IR Act, ORDERS – 1. THAT informal discovery is to be provided by 21 April 2023; 2. THAT the parties file a statement of agreed facts by 21 April 2023; 3. THAT the evidence in chief in these matters be adduced by way of signed witness statements which will stand as the evidence in chief of their maker.
