PR958098 PR958098 Download Word Document AUSTRALIAN INDUSTRIAL RELATIONS COMMISSION Workplace Relations Act 1996 s170NA(1) conciliation in respect of agreements Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union and Finlay Engineering Pty Ltd (AG2005/3981) Metal industry COMMISSIONER BLAIR MELBOURNE, 17 MAY 2005 Negotiations for agreement relating to BP2003/2702 STATEMENT [1] Following discussions today between the parties in the above matter and the Commission in regards to trying to reach an enterprise agreement Mr Sutton, on behalf of Finlay Engineering Pty Ltd (the Company), indicated that the Company was on the market for sale. [2] Mr Sutton indicated that any potential buyer may wish to negotiate their own enterprise agreement therefore he was not in a position on behalf of Finlay Engineering to agree to any new enterprise agreement to replace the existing one. [3] Following the discussions the Commission indicated that it would issue a statement in the following terms: 1. all employees are to be assured that the current enterprise agreement, although expired, continues to remain in place until such time that it is replaced by another enterprise agreement; and 2. Mr Sutton gave an undertaking to the Commission and to the Union that in the event that there is a positive buyer for Finlay Engineering then he will advise the Union as soon as possible of the name of that buyer and the contact person in order for the Union, on behalf of its members and the employees, to commence negotiations over a possible new enterprise agreement.
