1 Fair Work Act 2009 s.437 - Application for a protected action ballot order Transport Workers' Union of Australia v Broadspectrum (Australia) Pty Ltd T/A Broadspectrum (B2017/214) DEPUTY PRESIDENT BULL PERTH, 15 MARCH 2017 Proposed protected action ballot of employees of Broadspectrum (Australia) Pty Ltd. Pursuant to s.443 of the Fair Work Act 2009 (the Act) the Fair Work Commission orders: 1. PROTECTED ACTION BALLOT TO BE HELD The Transport Workers' Union of Australia is to hold a protected action ballot of employees of Broadspectrum (Australia) Pty Ltd described in clause 3 of this order. 2. NAME OF PERSON AUTHORISED TO CONDUCT THE BALLOT The ballot is to be conducted by the Australian Electoral Commission. 3. GROUP OR GROUPS OF EMPLOYEES TO BE BALLOTED In accordance with s.437(5) of the Act, the employees to be balloted are members of the Transport Workers’ Union of Australia, (TWU) employed in the classifications to be covered by the proposed agreement by the employer in the State of Western Australia, who will be subject to the proposed agreement and for whom the TWU is a bargaining agent. 4. DATE BY WHICH BALLOT CLOSES The date by which voting in the protected action ballot is to close is no later than 20 working days from 15 March 2017. 5. QUESTIONS The question(s) to be put to voters in the ballot are: “In support of reaching an enterprise agreement with your employer, do you support the taking of protected industrial action against your employer which involve one or more of the following: PR591000 ORDER PR591000 2 1. An unlimited number of bans on the performance of work for 1 hours? 2. An unlimited number of bans on the performance of work for 4 hours? 3. An unlimited number of indefinite bans on escort duties? 7. An unlimited number of indefinite bans on Military Integrated Logistics Information System (MILIS) duties? 8. An unlimited number of indefinite bans on oxygen and nitrogen changes? 9. An unlimited number of indefinite bans on explosive ordinance duties? 10.
