1 Fair Work Act 2009 s.156–4 yearly review of modern awards 4 yearly review of modern awards—Group 4—Social, Community, Home Care and Disability Services Industry Award 2010 (AM2018/26) JUSTICE ROSS, PRESIDENT DEPUTY PRESIDENT CLANCY COMMISIONER LEE MELBOURNE, 26 SEPTEMBER 2019 4 yearly review of modern awards – award stage – group 4 awards – substantive issues – Social, Community, Home Care and Disability Services Industry Award 2010 – Tranche 2 hearings [1] As foreshadowed at the Conference convened by Commissioner Lee on 10 September 2019, the Full Bench directs the parties to prepare a Court Book in preparation for the hearing listed for 15 – 18 and 22 - 23 October 2019. [2] The Court Book is to include the following: (i) the claims which are the subject of the October 2019 hearings; (ii) parties’ submissions in respect of each claim; and (ii) the evidence (statements and other materials) in respect of each claim. [3] Where a claim has been agreed the parties to the agreement are to file a joint submission referencing any evidence or documents in support of their agreed variation. [4] For the avoidance of doubt, the Court Book is to include all materials the parties intend to rely upon at the hearing. The Full Bench will not have regard to material other than that filed in addition to the Court Book. [5] The Court Book be provided to the Commission, in electronic form, to amod@fwc.gov.au by 4pm on Friday 4 October 2019.
