THE Commission, pursuant to the powers conferred under the Industrial Relations Act 1979 (WA), hereby orders by consent —
1. THAT the parties lodge with the Commission an agreed statement of facts no later than 4:00pm on 22 August 2024;
2. THAT the parties file any signed witness statements which it intends to rely upon on by no later than 4:00pm on 12 September 2024;
3. THAT evidence in chief in this matter be adduced by way of witness statements which will stand as the evidence in chief of the maker. Evidence in chief other than that contained in the witness statement may only be adduced by leave of the Commission.
4. THAT the parties file written submissions and a list of any authorities relied upon by no later than 4:00pm on 19 September 2024;
5. THAT the parties file any written submissions responsive to those filed by another party by no later than 4:00pm on 26 September 2024;
6. THAT each party notify each of the other patties whether they will require any witness who has filed a witness statement to be available for cross examination, by no later than 4:00pm on 26 September 2024;
7. THAT the matter be listed for hearing of a 1-day duration at 10:00am on Thursday, 3 October 2024.
8. THAT the parties have liberty to apply on short notice.
